1. Scope

These Terms and Conditions apply to contracts for the purchase of goods concluded through the online shop operated by:

hereinafter referred to as “VIRUS”, “we”, “us” or “our”.

These Terms and Conditions primarily apply to contracts with consumers.

A consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Deviating terms and conditions of the customer do not apply unless VIRUS has expressly agreed to them.

2. Products and External Shops

The products available directly through this online shop include sports equipment, snowboards, bindings, accessories and other products displayed for purchase on the relevant product pages.

Links to external websites or separately operated online shops do not form part of this online shop.

In particular, the “Fashion & Accessories / Mode & Accessoires” area may redirect users to an externally operated shop.

Purchases completed on such external websites are subject to the terms and conditions and contractual arrangements of the respective external provider.

These Terms and Conditions apply only to contracts concluded directly with VIRUS Sportartikel GmbH through this online shop.

3. Contract Languages

Contracts may be concluded in German or English.

4. Product Information

The essential characteristics of the products are described on the respective product pages.

Images are intended to provide an accurate representation of the products. Minor variations in colour, structure, material appearance or other characteristics may occur due to screen settings, manufacturing processes or the characteristics of natural or technical materials, provided that such variations are reasonable and do not constitute a defect under applicable law.

For individually manufactured products, the specifications agreed with the customer form part of the contractual product description.

5. Ordering Process and Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer. It constitutes an invitation to submit an order.

You may place products in your shopping cart and review the contents of the shopping cart before proceeding to checkout.

During the checkout process, you can review and correct your information before submitting your order.

By clicking the final checkout button that clearly indicates that the order entails an obligation to pay, you submit a binding offer to purchase the goods contained in your order.

After receiving your order, we will send you an electronic confirmation that your order has been received.

An automatically generated acknowledgement of receipt does not in itself constitute acceptance of your offer unless it expressly states that the order has been accepted.

We may accept your offer by:

  • sending you an express order acceptance or order confirmation;
  • sending you a shipping confirmation;
  • dispatching the goods; or
  • requesting or collecting payment where the circumstances of the selected payment method clearly indicate acceptance of the order.

The contract is concluded when the first of these events occurs.

Where a payment method used during checkout results in a different legally relevant point of contract formation, the information provided during the respective payment process applies.

6. Correction of Input Errors

Before submitting your order, you can identify and correct input errors using the correction functions provided during the ordering process.

You may in particular review and amend:

  • the products selected;
  • quantities;
  • billing information;
  • shipping information;
  • contact information; and
  • the selected payment method,

before submitting the final order.

7. Storage of Contract Information

We store order and contract information in accordance with applicable statutory requirements.

After placing an order, you will receive information concerning your order electronically.

Where a customer account is available, certain order information may also be accessible through that account.

The current Terms and Conditions can be viewed, saved and printed through our website.

We recommend retaining the order confirmation and applicable contractual documents for your records.

8. Availability of Products

Orders are subject to product availability.

If a product becomes unavailable after an order has been placed and no contract has yet been concluded, we may reject the order.

If a contract has already been concluded and delivery subsequently becomes impossible for reasons for which VIRUS is not responsible, the applicable statutory provisions apply.

For goods obtained from third-party suppliers, VIRUS may withdraw from the contract where:

  • VIRUS has entered into a corresponding procurement transaction in good time;
  • the supplier fails to supply VIRUS;
  • VIRUS is not responsible for the failure of supply; and
  • VIRUS could not reasonably have foreseen the unavailability.

In such a case, you will be informed without undue delay and any payments already made for the affected goods will be refunded without undue delay.

This provision does not affect your statutory rights.

9. Custom-Made and Individually Manufactured Products

Certain snowboards, skis or other products may be individually manufactured according to customer specifications.

This may include, depending on the respective product, individually selected dimensions, construction characteristics, flex characteristics, colours or other specifications that materially determine production.

The specifications confirmed during the ordering process or separately agreed with VIRUS form part of the contract.

Production and delivery times for custom-made goods may differ from those for stock items. The applicable information is displayed on the relevant product page, during checkout or communicated to the customer before conclusion of the contract.

The statutory right of withdrawal may be excluded for goods that are not prefabricated and whose manufacture is determined by an individual choice or decision of the consumer, or which are clearly tailored to the consumer's personal needs.

Further information is provided in our Right of Withdrawal Policy.

A mere adjustment or setup of an otherwise prefabricated standard product does not automatically result in the exclusion of the statutory right of withdrawal.

10. Prices

The prices applicable at the time the order is placed are displayed in the online shop.

For consumer orders subject to German VAT, the displayed final prices include the applicable statutory VAT.

Any additional shipping or delivery costs are displayed separately where applicable.

The total amount payable is shown during checkout before the order is submitted.

The information displayed in the checkout takes precedence with regard to the total amount payable for the specific order.

11. Shipping Costs

Shipping costs depend on factors such as the delivery destination, products ordered and selected delivery method.

Where shipping costs apply, they are displayed before the customer submits the order.

No additional shipping charges will be imposed after conclusion of the contract unless expressly agreed with the customer or required as a result of a subsequent change requested by the customer.

12. Delivery

Delivery is made to the shipping address provided during checkout.

Available delivery destinations and any delivery restrictions are displayed as part of the online shop and checkout process.

Delivery times are shown on the relevant product page or during checkout where applicable.

For individually manufactured products, the communicated production period must be taken into account in addition to the shipping period.

Where an order contains several products, VIRUS may make partial deliveries where this is reasonable for the customer.

The customer will not incur additional shipping costs solely because VIRUS chooses to make a partial delivery.

13. Payment

The payment methods currently available for a particular order are displayed during checkout.

Only the payment methods actually offered during the checkout process are available for the respective order.

Depending on the selected payment method, payment processing may be carried out by an external payment service provider.

The terms of the respective payment service provider may additionally apply to the payment transaction.

VIRUS remains the contractual seller of products purchased directly through this online shop.

14. Retention of Title

The goods remain the property of VIRUS Sportartikel GmbH until the purchase price has been paid in full.

15. Statutory Right of Withdrawal

Consumers generally have a statutory right of withdrawal in distance contracts.

The details, conditions, deadlines, consequences and statutory exceptions are set out separately in our Right of Withdrawal Policy.

The Right of Withdrawal Policy forms part of the consumer information provided in connection with purchases through this online shop.

16. Electronic Withdrawal Function

Where required by law, VIRUS provides an electronic function through the online shop that allows consumers to submit a withdrawal electronically.

The function can be accessed through the “Withdraw from contract / Vertrag widerrufen” link provided on the online shop.

The availability of this electronic function does not restrict the consumer's right to exercise the statutory right of withdrawal by another legally permitted method.

17. Additional Voluntary 14-Day Return Right

In addition to the statutory right of withdrawal, VIRUS voluntarily grants consumers an additional return period of 30 days from receipt of the goods, unless otherwise stated for a particular product.

This voluntary return right does not restrict or replace the statutory right of withdrawal or statutory warranty rights.

During the statutory withdrawal period, the statutory rules contained in our Right of Withdrawal Policy apply without restriction.

Where the statutory withdrawal period has already expired, the additional voluntary return right is subject to the following conditions:

  • the goods must be returned within the 14-day period;
  • the goods must be complete;
  • the goods must not show damage or signs of use beyond reasonable inspection;
  • accessories supplied with the goods must be returned with them.

The voluntary return right does not apply to:

  • products individually manufactured according to customer specifications;
  • products clearly personalised for the customer; or
  • gift vouchers, where applicable.

This exclusion from the voluntary return right does not affect any statutory rights the customer may have.

Unless VIRUS expressly offers free return shipping for the voluntary return period, the customer bears the direct cost of returns made solely under the voluntary return right after expiry of the statutory withdrawal period.

18. Statutory Warranty Rights

The statutory rights relating to defects apply.

VIRUS does not restrict the statutory consumer warranty rights through these Terms and Conditions.

If goods are defective, consumers are entitled to the remedies provided by applicable law.

Any additional manufacturer guarantee or voluntary warranty offered for a product applies in accordance with its respective guarantee conditions and does not restrict statutory rights.

19. Liability

VIRUS is liable without limitation:

  • in cases of intent or gross negligence;
  • for injury to life, body or health resulting from a negligent or intentional breach of duty;
  • where liability arises under the German Product Liability Act;
  • where VIRUS has expressly assumed a guarantee or procurement risk; and
  • in any other case where liability cannot legally be limited or excluded.

In cases of slight negligence, VIRUS is liable for breach of essential contractual obligations whose performance is necessary for the proper execution of the contract and on whose fulfilment the customer may normally rely.

In such cases, liability is limited to the foreseeable damage typical for the contract.

The above provisions also apply to the liability of VIRUS's legal representatives, employees and agents.

Statutory consumer rights remain unaffected.

20. Data Protection

Personal data are processed in accordance with applicable data protection law and our Privacy Policy.

Information regarding the processing of customer, order, payment, delivery, account and website usage data can be found in the Privacy Policy available through the online shop.

21. External Service Providers

VIRUS may use external service providers for the technical operation of the shop, payment processing, shipping, IT services and other functions necessary for fulfilment of the contract.

The use of external service providers does not alter the identity of VIRUS Sportartikel GmbH as the contractual seller for purchases concluded directly through this online shop.

22. Consumer Dispute Resolution

VIRUS Sportartikel GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

The former European Commission Online Dispute Resolution platform has been discontinued and is therefore not referenced in these Terms and Conditions.

23. Applicable Law

The law of the Federal Republic of Germany applies.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

For consumers, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence where such protection applies under mandatory conflict-of-law rules.

24. Final Provisions

If an individual provision of these Terms and Conditions is wholly or partially invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law.

Where a provision is invalid or unenforceable, the applicable statutory provision takes its place.
