1. Scope
These Terms and Conditions apply to all deliveries made by Virus Sportartikel GmbH (hereinafter “VIRUS”) based on orders placed through our online shop. Deviating conditions of the customer are not accepted unless VIRUS has expressly agreed to their validity.
2. Services
Through our online shop, you may order clothing and sports equipment for personal use in customary quantities. Orders for commercial or resale purposes are not permitted.
3. Contract Languages
The contract languages are German and English.
4. Conclusion of Contract / Order Process
By presenting products in our online shop, we make a binding offer to conclude a contract for those items.
A contract is formed when you accept the offer by clicking the “Buy” button in the final step of the checkout process.
Before submitting your order, a confirmation window allows you to review and correct your entries.
Immediately after sending your order, you will receive an email confirming receipt of your order (“Order Confirmation”).

5. Right of Withdrawal
5.1 Statutory Right of Withdrawal
Consumers (any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession, Section 13 BGB) have a statutory right of withdrawal.

5.2 Additional Contractual Right of Return
In addition to the statutory right of withdrawal, we voluntarily grant you a contractual return right of 30 days from receipt of the goods.
Unless otherwise stated, the provisions of Section 5.1 apply accordingly.
The contractual return period begins only upon receipt of the goods by the customer.
Excluded from the contractual right of return are:

food items (e.g., sports bars)

gift vouchers
-
customized skis and snowboards made specifically for the customer's weight, color preferences, or other individualized specifications
The additional contractual return right does not affect your statutory rights — especially your statutory withdrawal right (Section 5.1) and statutory warranty rights (Section 11).
6. Reservation of Self-Supply
If an ordered item is not available because our supplier fails to deliver to us without our fault despite a contractual obligation to do so, we may withdraw from the contract.
In such a case, we will inform you immediately and refund any payments already made.
7. Delivery / Shipment
Delivery will be made to the delivery address you provided.
We strive to deliver your order in a single shipment. If technical or logistical reasons require separate shipments — e.g., because items must be packaged or shipped differently — you will not incur additional costs.
However, if you pay by cash on delivery, the shipping company may charge a separate €3 cash-on-delivery fee per partial delivery.
For payments made via bank transfer (prepayment), the delivery period begins once payment has been received in our account.
8. Prices and Shipping Costs
The prices valid at the time of ordering apply. All prices are in euros and include the applicable statutory VAT.

9. Payment
You may choose from the payment methods offered during checkout.
For payment by bank transfer (prepayment), we will send you — in addition to the order confirmation — a separate email with payment details, including our bank account information.
Your order will be shipped only after payment is received.
The invoice amount must be paid within 10 days of receiving the email containing the payment instructions.
For international bank transfers, you are responsible for any fees charged by your bank.

10. Retention of Title
The goods remain the property of Virus Sportartikel GmbH until full payment has been received.
11. Warranty
Statutory warranty rights apply to defective goods.
12. Data Protection
Your order and the personal data you provide during checkout are stored by VIRUS.
All data is processed exclusively in accordance with applicable data protection laws and our Privacy Policy.
13. Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory international consumer protection regulations provide otherwise.
14. Alternative Dispute Resolution according to Art. 14(1) ODR Regulation and § 36 VSBG

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
We do not participate in such proceedings.
15. Miscellaneous
Should any individual provision of these Terms be or become invalid, this shall not affect the validity of the remaining provisions.
